Vážení přátelé,
je nám velikou ctí pozvat Vás na nejočekávanější přednášku Common Law Society tohoto semestru. V rámci Lord Slynn Memorial Lecture letos vystoupí soudkyně Soudního dvora EU za Nizozemsko, Sacha Prechal. Tématem přednášky bude „How does the CJEU cooperate with national courts?“.
Národní soudy hrají v evropském právu klíčovou roli – jsou do velké míry zodpovědné za jeho aplikaci, vymáhání a poskytování právní ochrany. V tomto procesu mohou a někdy musí spolupracovat se Soudním dvorem EU – zejména pokud vyvstane otázka interpretace nebo platnosti ustanovení evropského práva. Ve středu této spolupráce tak stojí řízení o předběžné otázce.
Řízení o předběžné otázce podrobně popisuje každá učebnice evropského práva. Ale jaký je jeho skutečný průběh? Jaké nástrahy se mohou v jeho rámci objevit? Jaké problémy jsou s řízením spojené a jaká řešení se nabízí? Lze spolupráci mezi národními soudy a SDEU vylepšit? Případně, nabízí se i jiné způsoby spolupráce než podávání předběžné otázky, které by přispěly ke kvalitnější aplikaci evropského práva?
Soudkyně Sacha Prechal ve svém příspěvku pohovoří o těchto otázkách z praktické perspektivy. Ilustruje je na konkrétních případech z praxe a umožní Vám tak nahlédnout „pod pokličku“ spolupráce mezi SDEU a národními soudy, která probíhá na denní bázi.

let us invite you to our annual memorial lecture dedicated to a great person and an outstanding lawyer Lord Gordon Slynn of Hadley. This memorial is intended to promote common law, European law and international law topics.
This year, we are proud to announce the lecture „How does the CJEU cooperate with national courts?“ which will be held by the Judge of the Court of Justice of the EU for Netherlands, Sacha Prechal.
In European Union law, national courts play a vital role: they are to a large extent responsible for the application and enforcement of that law and for judicial protection in cases where Union law turns up. In this process they may, and sometimes they must seek assistance of the Court of Justice of the European Union in the interpretation and on questions of validity of EU law. Preliminary procedure is central to this cooperation between the national courts and the Court of Justice. In any handbook of EU law one finds a detailed description of this procedure and its main features. However, how does this procedure work in practice? What are the potential traps in this procedure? What are the problems and how could they be solved? How can the collaboration between the national courts and the Court of Justice be improved? Are there perhaps also other aspects to the cooperation between the Court of Justice and national courts, beyond the preliminary procedure, that may contribute to better application of European Union Law?
In the Lord Slynn Memorial Lecture 2014 Judge Sacha Prechal is going to discuss these issues from a practical perspective, while using a number of everyday examples. The lecture will provide valuable insights from the daily practice of the cooperation between the Court and national jurisdictions.
